Terms and Conditions for Use of the In-house Counselling Platform:

Welcome to the in-house counselling platform, which provides confidential counselling services to the employees of APIC. The intended purpose of this document is to provide you with the terms and conditions on which APIC and its subsidiaries shall offer access to the in-house counselling platform. Please read these terms and conditions carefully before accessing and using this platform. By using this platform, you acknowledge that you have read, understood, unconditionally and irrevocably agreed to be bound by these terms and conditions. If you do not agree to these terms and conditions, you will not be allowed to access or use this platform. If you choose to agree to these terms and conditions and engage with the counsellor on this platform, this will be at your own free will and desire, and you will be bound with the following:

Nature of the Service:

You declare and agree that the services which will be offered by the counsellor through this platform are intended to provide you with a safer space enabling you to engage in a personal conversation with the counsellor. By accessing this platform, you understand and agree the counsellor will not be acting as a therapist or a psychologist. Instead, the counsellor is intended to provide you with assistance, support and guidance in the hope that this would cater for your personal wellbeing, promote the wellbeing of the workforce and facilitate your interaction with the workforce. Bearing in mind the aforementioned, the counsellor will be expected to cater for and be available to assist the entire workforce of APIC. As such, the counsellor will have to distribute the sessions in a fair manner amongst those wishing to receive counselling. You will therefore be entitled to receive a total of up to 6 sessions per annum. Should you wish to continue beyond that number of sessions, we urge you to consult with a professional specialized therapist or a psychologist and any costs incurred thereof shall be at your own expense. The counsellor may direct you or recommend a therapist or psychologist within your city. Moreover, you understand and agree that the counsellor, at her own free will and accord, may stop any of the counselling services or limit the number of sessions which will be available for you in the event the counsellor believes that you will be in need of a therapist or psychologist or in the event the counsellor determines no need for continued services.

Confidentiality:

When using this platform, the counsellor shall be under an obligation to uphold and to keep all information disclosed by you during any session in strict confidence. The counsellor is under obligation not to disclose any information provided by you to APIC. However, the obligation to keep information confidential shall not apply in cases where the counsellor is obligated by operation of the law or to disclose same to the governmental authorities.

Cost:

Please be advised that your use of the In-House Counselling Platform and any sessions up to 6 sessions per annum held with the counsellor will be free of charge. For accounting purposes and in order for APIC to arrange settlement of the counsellor’s fees, you hereby authorise in a final and irrevocable manner the counsellor to disclose your full email address (with your name hidden/blacked out such that only the domain name of the company is visible), the number of sessions you received and the date and duration of such sessions, and you consent in a final and irrevocable manner and permit APIC to receive the said information.

APIC is not Responsible for the Results or Outcomes:

By accepting these terms and conditions, you understand and agree that the counsellor will provide counselling services to the best of their abilities and ultimately any positive results yielded from participating in the counselling services will vary and depend on you and on your own willingness to cooperate with the counsellor. IN ALL CASES, you understand and agree that accessing this Platform and utilizing the counselling services does not guarantee that there will be positive results and as such APIC shall not be responsible for any results, which you directly or indirectly obtained from or through the counselling sessions. You agree that the guidance and support provided by the counsellor does not constitute binding medical advice. APIC shall not in any way be held responsible for any decisions made by you as a direct or indirect result of the counselling sessions.

Usage of the In-House Counselling Platform:

The In-House Counselling Platform is a service retained by APIC and will be made available for your use subject to the terms and conditions set forth. You agree that any unauthorized use or access to the platform is strictly prohibited and may hold you personally liable. You are requested not to share your login credentials with anyone else. You understand and agree that APIC reserves the right to terminate your access to the platform and cancel this privilege of using the Platform at any time for any reason and without cause. In such a case, APIC shall not be under any obligation at any time to provide any alternative services under any circumstances. Should it be determined that you passed on or made available your login credentials to any other person, APIC shall be entitled to seek the cost of the session from you as well as claim any other damages. You hereby authorize APIC in advance to deduct such cost from any dues (salary or end of service entitlements).

Disclaimer of Warranties:

You understand and agree that by accessing this Platform, APIC is not providing any warranties, either express or implied. You understand and agree that this Platform is not a substitute for medical or mental health advice nor is able to provide you with a prescription medicine. You are advised to seek professional help if needed and not rely solely on the counselling services provided through the platform.

Limitation of Liability:

In no event shall APIC, any of its subsidiaries or the counsellor providing you with any services through the Platform be liable for any direct, indirect, incidental, special, consequential damages, or punitive damages arising out of or in any way connected with your use of the platform or the counselling services, whether based on contract, tort, strict liability, or otherwise.

Modification of Terms and Conditions:

APIC reserves the right to revise/modify/update these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting to the platform. APIC will do its best to notify you of any such update upon accessing the Platform.

Governing Law:

These terms and conditions shall be governed by and construed in accordance with the laws applicable in the West Bank, Palestine. Any dispute arising in relation to these terms and conditions shall be referred to the courts presiding in the City of Ramallah, Palestine. These terms and conditions have been issued and set in effect on August 20th, 2023.
